| Below is a collection of emails from Point Center Investors and Industry Professionals expressing their thoughts amidst the recent ongoings. | ||
| Emails from Investors | ||
| “I understand congratulations are in order. I think I'm pretty well up to date on the loans. You guys communicate well. I'm also fully in support of you continuing to service our loans. I think you did a good job selecting and qualifying potential loans and think you are doing a good job of trying to protect all of our interests in this difficult time. I want you to be there to help us through this. All I ask is continued status updates as appropriate. Keep up the good work.” -Investor | ||
| “I have been investing with Dan Harkey for over 20 years in both good times and bad. In both cases, I have always found him to be forthright and conscientious. Accordingly, I find it very hard to believe any of the charges I have recently heard and expect him to be totally exonerated when he gets his day in court.” -Investor | ||
| “I want to thank you and your entire team for hanging in there during these difficult times. We appreciate receiving your regular updates and want to compliment you on the most recent brochure/update. We also appreciate receiving the interesting report on your neighbor which is a good reflection on his character. Keep up the good work and I know you will as you also have a vested interest in seeing positive results." - Investor | ||
| “Always good talking to you, Dan. I can tell you that if you get us our money back in the next few years, you’ll have over 1,000 folks who would never invest anywhere else; only with you!!” –Investor | ||
| "Thanks to you and everyone on your team for hanging in there through these tough times. I appreciate the newsletter. Receiving information of your progress helps to calm fears in this uncertain market. It's great knowing that your team is hard at work preserving our assets." -Investor | ||
| “Keep up the good work. As difficult as the market is, we believe you are best suited to manage our investment for the best return.” -Investor | ||
| “You and the team, Hang in there.” –Investor | ||
| “I think that the "silent majority" of Point Center investors who believe in and support you and your staff will need to come out and show their public support. The Charton group needs to be very clear about their intentions and objectives, and how their actions are going to help us all recover the maximum amount of our investments. In this unprecedented and unforseen home equity situation, we have seen other companies throw in the towel -- that would be a disaster for us all.” -Investor | ||
| "Dan, you and your staff are heroes to us. Who else would work so hard on our behalf in spite of Lloyd Charton gumming up the works with his character assassinations. Pt Center is a company who has set the standard in their field. (By the way, Dan took the time in the middle of this crisis to help counsel my husband and I on a personal crisis.)" -Investor | ||
| “Thank you for your continued communications. We really need to hear your side of things so that we get a balanced view. We very much appreciate the extraordinary effort that you and your staff are making to keep Point Center afloat and protect our investments. Good luck to you and your team.” -Investor | ||
| “We just wanted to express how much we appreciate your steadfastness and loyalty to us as your investors. Even though times are tough and the future is very uncertain.....ie. we have not experienced this level of irrationality in the markets (real estate and otherwise), it is good to have Pt. Center and your leadership staying the course and reassuring your investors that as much as depends on you, you will not "bailout" and leave us all to fend for ourselves in our losses. In a world where there is not much integrity, where government leadership is "robbing the rich to pay the poor", and one where we have a President who doesn't seem to know how to choose leaders of good character.....he doesn't even seem to know of anyone who fits that description and wouldn't recognize that as a necessary quality anyway, it is a breath of fresh air to find someone who cares about his investors and his business as you do. We just wanted to let you know this so you would be hopefully encouraged as you go through all of the challenges of having a crazy neighbor and striving to work through to an acceptable financial conclusion the investments that we have made through Pt. Center. You might remember that [Jane Doe’s] son, was with her last time they came to the Pt. Center offices and you graciously gave them your time and some good advice which he appreciated.” –JJ and Janet, Investors |
||
| “Just wanted to let you know you have our full support. Appreciate all that you are doing to deal with these unprecedented times and let you know that Point Center fully disclosed the risks of the investment that we made and that we understood the increased risks associated with higher returns. We harbor no hard feelings against Point Center regarding the state of our investment. Best of luck to you and your employees.” -Investors | ||
| “Thank you for hanging in through these tough times and standing behind your product. Come what may, PCF continues to present a solid foundation of high professional standards including capable personnel, solid organization and clear investor communication. You can be proud of your team as I remain confident in Point Center Financial's efforts during these very challenging times” - Brandt Davis | ||
| “Sorry you are faced with this harassment. It does us all no good, and is costly for you or us or all of us. If someone had wanted a safe investment, a bank CD or Government Securities would have been the way to go. Anyone wanting a 10% or better rate of return better be willing to accept risk!!!” –Investor and CPA | ||

| Subject: Danny Harkey Fellow Board Members: “I spoke with Danny Harkey this week. Danny very much appreciates everyone's support and comforting emails. Danny says it's always great to know in challenging times that each of us has supporters. Danny pointed out, very specifically, based on his conversation with the reporters from the LA Times and of the Orange County Register that his newsworthiness is only a byproduct of being married to State Assemblywoman Diane Harkey. Just like my investor base and CMA member's investor base, some clients are Democrats and some are Republicans. We all get along to the extent that we have mutual objectives. Past actions by his client, Lloyd Charton and his small group, have resulted in Charton's defeat in two different Department of Real Estate Complaints, one mediation and one civil court action. The next hurdle will be responding to the SEC's request for information. Danny is confident that upon forwarding the relevant documentation that the result will be one of no action by the SEC…” –Industry Professional |

| “We are a 100% behind you!” –Commercial Mortgage Lender | ||
| “I believe in you and in all the years I have known you and represented you I have never seen you break the law or act in any dishonest manner. It’s a shame the government is blaming hedge and other funds for their own negligence in managing our economy.” –Business Professional | ||
| “I know you have a lot swirling about lately, but I wanted you to know that I believe this lawsuit is utter crap and I’ll stand up for you as a character witness any day of the week. And everyone else I’ve talked to that knows you and some that don’t, think this ponzi scheme allegation is nothing more than an attempt to try and align you with those in the news lately that have committed real fraud. As your former assistant said to me recently, “I worked as Dan’s assistant for ten years and he made sure every T was crossed and I dotted….” I just wanted you to know you have a lot of us standing behind you through this. Hang in there.” –Matthew Alex, Industry Professional | ||
| “Good Luck with your side of the legal battle. News articles are stretched thin when they reflect facts and a sell on a dime for a good copy. Good luck, and I’m sure you will prevail in court considering your high regard for due diligence, and attention to detail and information.” –Industry Professional | ||
| “You have been a tremendous influence in my business success. It was the fall of 1976 at ETHS when I first met you; as a student in your accounting classes and then running the student store under your supervision. While you went on to many other challenges and successes I still remember how you helped to guide me into the business arena. Over the years I have quietly watched you build one incredibly successful business after another. Your hard work, integrity, and attention to details has always been nothing short of astonishing to me. I feel quite privileged to be able to say I was one of your students and am always willing to tell people that as far as I’m concerned you’re the best in the industry. It’s sickening to see how the media is trying to portray you and your business. While I’m just a little fish, I do want you to know if there’s anything I can do, please let me know. I have always admired you and will continue to do so. Thank you for everything you have done for me as your student and for the guidance and lessons you have taught me and many, many other in the industry about how to operate a successful business over all of these years.” –Industry Professional |

| “I have seen the recent articles in the L.A. Times with regard to the lawsuit by investors and SEC investigation. These things have a tendency to be overdramatized and played up by the press who seem to love to parade “hard money” lenders around on a skewer. Speculation and sensationalism sell newspapers while, sadly, the facts and historical compliance get little ink. In the meantime the whole world grinds to a halt in large part due to Banks having completely abandoned any, and all ethics. Go figure. Keep your head up and hang in there, Dan. If there is anything that we can do to help, please let me know. Good luck with everything and give ‘em hell.” –Industry Professional | ||
| “Just wanted to write you a note to encourage you. You are an honest man and a great businessman. You will persevere and overcome the adverse market conditions. I appreciate how you helped my family in 2004 in a business transaction. I know first hand of your honesty and integrity.” –Industry Professional | ||
| “In this busy time for you, I just wanted to let you know you are doing a great job as always. Please let me know if I can help you in any way as a former investor and CPA. I thought your letter was extremely well written. We are sorry that you have to go through all of the stress.” –Business Professional | ||
| “Sorry to see you the target of so much grief with this lawsuit. I just thought you might appreciate a kind word in the midst of all the ugliness. I know you did the right thing by your clients and that you will be exonerated. As usual, the media is hyper-sensationalizing all of this. I know you’ll come out of this as the good guy, but I am certain it is an undue burden and unfair hassle in the interim.” –Business Professional | ||
